Top HIPAA Myths:

1. “We use an EMR/EHR, so we are compliant.”
- Using an EHR does not mean that you are HIPAA compliant. Though important, EHR is a fraction of the minimum legal requirements.

2. “We are a small practice, so HIPAA is not a top priority.”
- There are no exemptions from HIPAA based on size of practice, rural or urban location, or medical specialty. All health care providers in the United States are required to comply.


3. “The chances of getting audited are slim. We’ll be fine.”
- More than 75% of HIPAA-related legal and breach costs stem from incidents, such as improper use, disclosure, theft and hacking.


4. “We don’t have any major incidents.”
- It doesn’t take a major incident. The average provider who experiences any publicized breach experiences a 40% loss in patients within 12 months, so the true cost of an incident is not determined by the incident’s severity.


5. “We are covered because we are doing a Security Risk Assessment via HHS Checklist.”

6. “We are already certified”
